Appeals Court Hears Groundbreaking Abortion Case

A federal appeals court in St. Louis heard arguments today in a potentially groundbreaking case that — for the first time, according to attorneys — addresses the question of whether an abortion terminates a human being’s life, according to a CNSNews.com article.

One legal website offers additional insights into the case, Planned Parenthood vs. Mike Rounds (South Dakota’s governor), being heard by the U.S. Court of Appeals For The Eighth Circuit:

  • It implicates some of the most important legal and factual issues involving the rights of pregnant women against the dereliction, misrepresentations, and negligence, of abortion providers;
  • It is “the first and only case of its kind which establishes the duty of a physician to make disclosures to a pregnant mother of a biological nature concerning her unborn child, and establishes a claim for the emotional distress of the mother due to the death of a child in utero in very early gestation”; and
  • The case involves the suicide death of a college woman following abortion. The case implicates important issues concerning pyschological harm of the abortion procedure that is denied by the providers.
