My Prius goes 80 without any problems at all... 100 wouldn't be an issue. It might take a while to get UP to 100 mpg, tho... I'll bet he doesn't get 50 MPG going that fast! You know Daddy bought him that car....

Smoking Gun has some details. It may be important to note that the other arrests were not in the state of California. I took a look at the law, and of course it is written in lawyer language.

If I am reading it right, the laws he broke previously would have to be considered felonies by the state of California for this to apply, and he would have to be convicted.

His other arrests were for possession in Maryland and endangerment in N. Carolina. He had pot in Maryland, and was driving twice the speed limit in NC.

http://www.thesmokinggun.com/archive/gorebust1.html

CNN has an article claiming that the pot charges led to a deal that clears him of any conviction. It also claims that the endangerment charges were dropped in the other case. No conviction means no strikes.
http://www.cnn.com/2004/ALLPOLITICS/02/02/gore.son.ap/index.html

Now I did find an old NewsMax article claiming that he was busted for DUI.
http://www.papillonsartpalace.com/mediain.htm
The article gives the impression that the story was buried. But the other CNN article does mention the DUI ticket, but does not say anything about a conviction.

So this seems to actually be his 4th arrest. But there is confirmation from CNN that two of them led to no conviction. If he was convicted of the DUI, it would only be one strike.

As entertaining as it would be, third strike doesn't seem to apply here. It will be interesting to see how this plays out though given past arrests. To get the pot charges dropped, he had to agree to some 'getting clean' measures. It seems they didn't work the first time.
