Late last night, retired Air Force CMSgt. John Stewart informed me that the appeal filed by the lawyer for his son, former Army Sgt. 1st Class Kelly Stewart, whose life story and wrongful conviction are chronicled in my book, Three Days In August: A U.S. Army Special Forces Soldier’s Fight For Military Justice, was successful and has earned Kelly a hearing. Though the exact date of the hearing has not been set and a hearing, in and of itself, guarantees nothing, this news does offer reason for hope.
UPDATE 3/6/12 at 5:41 p.m. Central: The hearing will take place April 19 at 10 a.m. Eastern at 9275 Gunston Road, Fort Belvoir, Va. All are invited and encouraged to attend.
UPDATE 3/16/12 at 5:24 p.m. Central: I just learned that the Court of Appeals of the Armed Forces has set April 23 at 9 a.m. Eastern as the date/time of a hearing for Army Ranger 1LT Michael Behenna‘s hearing in Washington, D.C. Lieutenant Behenna is the Edmond, Okla., native about whom I’ve written dozens of pieces during the past several years. He was wrongly convicted of killing a known Al-Qaeda operative after Army prosecutors ignored their own expert witness who was prepared to testify that the man’s death was, indeed, attributable to self-defense on Behenna’s part. What is it that’s being appealed in Stewart’s case? Here’s a quick rundown:
A highly-decorated Green Beret combat veteran, the younger Stewart is now on parole and carrying the “sex offender” label after being convicted by a court-martial panel in August 2009 of committing crimes against a young German woman and serving almost 19 months in prison at Fort Leavenworth. Thanks, but be careful now at there’s no guarantee yet that he’ll get a new trial or have his conviction overturned.
